As a European company, we are accustomed to the fact that honest business is a partner of the state, and any issues can be resolved in the legal field. But in Ukraine, this rule, based on our experience, does not work.

In many languages of the world there is a proverb, the Estonian version of which sounds like this — "Kes teisele auku kaevab, see ise sisse kukub". Or "curses like chickens come home to roost." Over the past year, we have been watching by our own example how the state of Ukraine is sending "curses" to working businesses, which will very soon "come home" to the entire Ukrainian economy and international investment.

About a year ago, we accidentally learned that the Arricano business in Ukraine is the subject of criminal proceedings, the content of which is not just erroneous, but literally absurd. The key accusation is the assumption of the investigation that the Arricano Real Estate Plc shopping malls in Ukraine financed the terrorist state - russia - in 2022-2023. Such accusations are absurd from a technical point of view — since 2022, according to the NBU resolution, there is an extremely limited range of financial transactions that can be carried out by Ukrainian companies outside Ukraine. But the security forces and the prosecutor's office are not interested in this argument and completely transparent reporting of the company. And I am sure that the point here is not at all in the desire to stop someone's illegal activities.

From the very beginning — all the lawyers we worked with, consultants and partners said one thing — They put a contract on your business. Most often we heard about the permissiveness of the security forces, about the abuse of powers — as a system of relations between the government and business, various sources called the names of the heads of the SBU units and their "curators", who, according to them, are the main interested persons. But we were sure that the court would definitely be on our side, because the absurdity of the accusations is obvious. As a result, we faced a situation when, under the same arguments of the prosecutor's office, one judge of the Solomianskyi Court decides to seize part of the assets and accounts and transfer them to the ARMA management, and the other considers the arguments of the prosecutor's office insufficient and refuses to block the other two shopping malls.
